BuildCleverly™ Terms Of Use

These Terms of Use govern your access to and use of the BuildCleverly™ platform, including contractor listings, homeowner memberships, project postings, BuildCleverly™ Framework participation, and related services.
Welcome to BuildCleverly™. These Terms of Use constitute a legally binding agreement between you and Jennifer Ivanov Real Estate regarding your access to and use of the BuildCleverly™ platform. By accessing the platform, creating an account, claiming a listing, posting a project, uploading content, or participating in the BuildCleverly™ Framework, you agree to be bound by these Terms of Use.
1. Purpose of the BuildCleverly™ Framework
The BuildCleverly™ Framework is a voluntary construction risk-management framework designed to encourage transparency, documentation, and informed decision-making between homeowners and contractors.
The Framework provides educational resources, recommended procedures, and optional project-management practices intended to help reduce construction risk.
Participation is entirely voluntary.
Neither homeowners nor contractors are required to use every recommendation contained within the Framework.
2. Nature of the Platform
BuildCleverly™ is an information platform and construction connection service.
Jennifer Ivanov Real Estate and BuildCleverly™:
- are not contractors
- are not project managers
- are not construction supervisors
- are not escrow companies
- are not inspectors
- are not attorneys
- are not engineers
- are not architects
The platform simply provides information and recommended procedures.
3. No Certification or Endorsement
Participation in the BuildCleverly™ Framework does not constitute:
- certification
- licensing
- endorsement
- recommendation
- approval
- accreditation
- bonding
- financial qualification
- verification of skill
- guarantee of workmanship
- guarantee of project completion
Contractors remain solely responsible for their own work.
4. Contractor Responsibilities
Contractors choosing to participate agree that they intend to follow the BuildCleverly™ Framework.
Participating contractors agree to provide and maintain accurate information within their own member profile, including applicable documentation they choose to upload.
Contractors remain solely responsible for:
- keeping information current
- maintaining licenses where required
- maintaining insurance
- complying with applicable laws
- honoring agreements made with homeowners
5. Homeowner Responsibilities
Homeowners remain solely responsible for determining whether a contractor is appropriate for their project.
Homeowners should independently verify, among other things:
- licenses
- insurance
- references
- experience
- project suitability
- financial arrangements
- legal compliance
Participation in the Framework does not eliminate the need for independent due diligence.
6. Uploaded Documents
Contractors are solely responsible for all documents uploaded to their BuildCleverly™ profile.
BuildCleverly™ does not guarantee that uploaded documents are:
- authentic
- current
- accurate
- complete
- legally sufficient
7. User Content
Homeowners are responsible for reviewing and independently verifying any documentation before relying upon it.
Users remain solely responsible for all information, photographs, documents, project descriptions, comments, reviews, proposals, and other content submitted to the BuildCleverly™ platform.
By submitting content, users represent that they have the legal right to upload or publish such content and grant BuildCleverly™ a non-exclusive license to display, reproduce, and distribute such content solely for the operation and promotion of the platform.
BuildCleverly™ reserves the right, but not the obligation, to remove content that violates these Terms of Use or applicable law.
8. No Verification
Jennifer Ivanov Real Estate and BuildCleverly™ do not independently verify:
- identities
- licenses
- insurance
- business registrations
- references
- financial condition
- project history
- background information
- criminal history
- creditworthiness
- project funding
- uploaded documents
- inspections
- project completion
Any information displayed on the platform may change after it is submitted.
9. No Fiduciary Relationship
BuildCleverly™ does not act as an agent, broker, fiduciary, employer, joint venturer, or representative of homeowners or contractors.
Each party acts independently.
10. Construction Contracts
Any agreement entered into between a homeowner and contractor is solely between those parties.
BuildCleverly™ is not a party to:
- construction contracts
- payment agreements
- change orders
- disputes
- warranty claims
- lien claims
- insurance claims
11. Third-Party Services & Platform Fees
BuildCleverly™ may integrate or provide access to optional third-party products and services designed to support homeowners and contractors throughout the construction process. These services may include, but are not limited to, escrow and payment administration, electronic signatures, document management, inspections, identity verification, insurance verification, project management tools, communication tools, financing resources, and other construction-related services.
Use of any third-party service is voluntary and subject to the provider’s own terms, conditions, privacy policies, and applicable fees. Jennifer Ivanov Real Estate and BuildCleverly™ do not own, operate, or control third-party providers and are not responsible for their products, services, actions, omissions, availability, pricing, or performance.
BuildCleverly™ may charge separate technology, platform, connection, subscription, or service fees for certain optional features or services. Any applicable fees will be clearly disclosed before a user elects to use such features or services.
12. Escrow Services
BuildCleverly™ does not receive, hold, control, or distribute client or project funds. Where escrow services are utilized, funds are held and administered solely by an independent third-party escrow provider selected by the parties. BuildCleverly™ is not an escrow company and is not responsible for the administration, release, or security of escrow funds.
13. Inspections
Where the Framework recommends inspections, homeowners remain responsible for selecting their own inspectors and determining whether inspection results are satisfactory.
BuildCleverly™ does not inspect construction work or guarantee compliance with building codes.
14. Waiver of Framework Protections
Homeowners may voluntarily waive one or more Framework recommendations.
Such waivers should be documented in writing.
A homeowner’s decision to waive a recommendation does not alter a contractor’s participation in the Framework.
15. Limitation of Liability
To the fullest extent permitted by law, Jennifer Ivanov Real Estate and BuildCleverly™ shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:
- contractor performance
- homeowner actions
- payment disputes
- project delays
- construction defects
- injuries
- property damage
- financial losses
- liens
- fraud
- misrepresentation
- inaccurate information
- uploaded documents
- decisions made by users
All project decisions remain solely the responsibility of homeowners and contractors.
16. Intellectual Property
The BuildCleverly™ name, BuildCleverly™ Framework, logos, graphics, educational materials, checklists, downloads, website content, and related intellectual property are owned by Jennifer Ivanov Real Estate unless otherwise indicated.
No portion of the platform may be copied, reproduced, distributed, or used without prior written permission except as expressly permitted by law.
17. Changes to These Terms
BuildCleverly™ reserves the right to modify these Terms of Use at any time. Updated versions will be posted on this page with a revised Effective Date. Continued use of the platform following any changes constitutes acceptance of the revised Terms.
18. Account Suspension or Termination
BuildCleverly™ reserves the right to suspend, restrict, or terminate user accounts, remove listings, revoke Framework participation, or remove content that violates these Terms of Use, applicable law, or the integrity of the BuildCleverly™ platform. BuildCleverly™ may take such action with or without prior notice when reasonably necessary to protect users or the platform.

By using BuildCleverly™, submitting information, participating in the Framework, creating an account, claiming a listing, uploading documents, or using any services provided through the platform, users acknowledge that they have read, understood, and agree to these BuildCleverly™ Terms of Use.
